These Terms & Conditions govern the booking and provision of guided experiences offered through tolomazia.com. By submitting a booking you confirm that you have read and accepted these terms in full.

2. The service

We offer private, guided experiences in Venice and its lagoon — including boat tours, island excursions and gondola aperitivo experiences. The description, duration, meeting point, price and maximum group size for each tour are shown on the relevant tour page on this website.

3. Bookings

A booking is submitted through the website by selecting a tour, date, time and number of participants, and by providing your contact details. Your booking is confirmed when you receive a confirmation email from us. We may contact you before the tour to confirm the exact meeting point and any last-minute details.

We reserve the right to decline a booking if the requested date or group size is unavailable. In that case we will contact you promptly to offer an alternative.

4. Prices and payment

• Prices are shown in euro (€). Unless otherwise stated, prices are per person. Any applicable child or group rates are shown at the time of booking.
• No payment is taken online. Payment is made directly to the guide at the start of the tour, in cash or by card. In accordance with Italian law (D.L. 36/2022, art. 18), electronic payment is accepted upon request.
• Prices include guide fees and any boat or transport costs specified in the tour description. Optional extras (meals, entrance fees, etc.) are purchased separately on the day.

5. Cancellations and changes

• Free cancellation: you may cancel or reschedule at no cost up to 72 hours before the start of the experience. Please notify us by email at info@tolomazia.com or by phone.
• Late cancellation: cancellations made less than 72 hours before the start time, or no-shows, may not be eligible for rescheduling at no extra cost.
• Weather and exceptional circumstances: tours operate in most weather conditions. In the event of severe weather or force majeure that prevents us from running the experience, we will offer to reschedule at no additional cost, or — where applicable — provide a full refund of any amount already paid.
• Cancellation by us: if we must cancel for reasons within our control, we will contact you as early as possible and offer a full refund of any amount paid or a free rescheduling.

6. Participant responsibilities

• Please arrive at the agreed meeting point at least 10 minutes before the start time. Late arrivals may result in a shortened experience without any adjustment to the price.
• Wear comfortable clothing and footwear suitable for walking and, where applicable, for being on a boat or gondola.
• Participants must follow the guide's safety instructions at all times. We reserve the right to exclude any participant whose behaviour poses a risk to others, without refund.
• The minimum age for participation may vary by tour and is indicated on the tour page. Children must be accompanied by a responsible adult.

7. Liability

We take every reasonable precaution to deliver our experiences safely and as described. To the extent permitted by mandatory Italian and EU consumer law, our liability is limited to circumstances directly caused by our breach. We are not liable for loss or damage arising from force majeure, the conduct of third parties, or circumstances that could not reasonably have been foreseen. Nothing in these terms excludes or limits liability that cannot be excluded under applicable law.

8. Right of withdrawal

Under EU and Italian consumer law (art. 59, D.Lgs. 206/2005 — Consumer Code; art. 16(l), Directive 2011/83/EU), contracts for leisure and tourism services to be performed on a specific date or within a specific period are exempt from the standard 14-day right of withdrawal. The cancellation terms set out in section 5 apply instead.

9. Privacy

Your personal data is processed in accordance with our Privacy Policy, available at tolomazia.com/privacy.html.

10. Governing law and jurisdiction

These terms are governed by Italian law. For disputes involving consumers, the competent court is that of the consumer's place of residence or domicile, as required by mandatory consumer-protection rules (art. 66-bis, D.Lgs. 206/2005). In all other cases, the competent court is that of Venice, Italy.
